Mr. Dean had retired and sold his business, but still owed approximately $42,000 on a trucking lease agreement that he had breached as he was closing down his business. Bankruptcy was not a viable opti ... on due to non-exempt personal property that would be liquidated, and his current income did not allow for a repayment/reorganization. I was able to negotiate the $42,000 lease deficiency to a $2,000 settlement for the benefit of my client.

Ms. Jones had lost her home through judicial foreclosure after being laid off for more than a year. Her home sold for substantially more than she owed on the foreclosure judgment. I was able to petitio ... n the court to pay the surplus to Ms. Jones, over the objection of a junior mortgage lien holder as well as a judicial lien holder, after they both failed to timely answer the foreclosure.

Married couple, both seeking relief in bankruptcy. Combined household income put them well over-median income. Wife had marital debt assigned in a divorce decree from a prior marriage. Husband's debt w ... as primarily consumer credit card. Wife benefited from the 1328(a) discharge which can eliminate debt that would otherwise be excepted from discharge per 523(a)(15). By splitting the household, we successfully eliminated the wife's debt in chapter 13, and were able to claim the wife's chapter 13 payment as a spousal adjustment when we filed the husband's over-median chapter 7.
