DUI Crash with Enhanced Breath Dropped to Reckless Driving

Client was in a very severe car accident in which the other driver was taken to the hospital. Officers arrived on the scene and can clearly tell that client is impaired. Client admits to being the driv ... er and to drinking. After a DUI Investigation in which Client did field sobriety exercises and provided breath samples, both above the legal limit, Client was arrested. After being retained, I was able to go through all the body worn camera, and depose the officers and find out that despite all the evidence against Client, the officers did not have probable cause to arrest him. Based on the motion the State Attorney offered a reckless driving before the motion was heard by the Judge.

Facts of client case: client was pulled over for speeding at 3 AM, officer approaches his vehicle and sees that he is not wearing any pants and had vomit on his shirt, client also admits to drinking. Before the trial, the officers were laughing about this case in the hallway saying it was a slam dunk, and could not believe that this case was going to trial. During the trial, they were made to eat t ... hese words as I was able to show the jury that these officers were not credible and their case did not have enough evidence. Not only did the officers make up facts on the stand, but the DUI Officer could not even articulate what clues of impairment he was looking for during the field sobriety exercises. The jury was quickly able to see through these officers are returned a NOT GUILTY verdict in less than 15 minutes.

The Government overcharged my client with Armed Carjacking, a charge which if convicted would lead to a sentence of life in prison. The Government would not budge and change the charge. At the Jury trial we argued that it was a grand theft auto - a third degree felony - and not armed carjacking. The jury agreed that the Government did not have the evidence and returned a verdict of not guilty of armed carjacking - or any other offense other than the grand theft auto that we conceded.
