Client was assaulted by a co-employee of Astroworld. She had a very difficult time finding an attorney because lawyers she consulted would not take the case because of Texas Worker Compensation Laws. I ... felt that the personal animosity exception applied and I agreed to take her case. Case was dismissed by trial court stating that Texas Worker Compensation law pre-empted her case. Ultimately the case was decided by the court of appeals in our favor. Villanueva v. Astroworld, Inc. 866 S.W.2d 690, finding that the personal animosity expcetion applied. This case has been cited more than 20 times by other cases and in various employment law and worker compensation treatises.
