Mental illness in a family poses special challenges. I recently helped a mother gain limited guardianship over her mentally ill daughter. This will allow her to keep her daughter in a protected resid ... ential environment while her daughter adjusts to new medications. It also allows her to have access to her daughter's medical records and monitor her condition. If her daughter runs away from the facility and is injured, the hospital will be required to notify the mother of her daughter's whereabouts and condition. The guardianship cannot force the daughter to take her medications, but it allows her family to control where she lives and to consent to needed medical treatments.
