OUTCOME: Following the decision of the Court of Appeals, the case was settled for our client for a substantial amount.

We represented the Plaintiff Greenwald in this case. The Court of Appeals ruled that predictions of future events interwoven with misrepresentations of existing fact were actionable by Plaintiff.

OUTCOME: We recovered the plaintiff's entire investment.

This was a private right of action for fraud and deceit brought under the Commodity Exchange Act. It was a companion to the case in which the United States Supreme Court established that there is a pri ... vate right of action under the Commodity Exchange Act.

FIRST FEDERAL SAVINGS & LOAN ASSN v. ABBOTT et al., 231 Ga. 864, 204 S.E.2d 594 (1974)

OUTCOME: Our client recovered the intangibles tax paid with the recording of the deed to secure debt.

The Supreme Court held that First Federal’s promissory note secured by Georgia real estate was not subject to Georgia intangibles tax because the note did not have a Georgia taxable situs.
