Here is a case where an individual was detained and in removal proceedings. He was detained at Stewart County Detention Center. Bond was denied by Judge Arrington. He had been convicted of possession ... of less than an ounce of Marijuana. The sentence had been modified by his criminal defense attorney and Judge Arrington wanted to pierce the veil of the conviction to find out why the case was modified. She did not let me submit proper pleadings because the client's previous attorney failed to appear in his hearing multiple times. When I denied removability as my client was an LPR, Judge Arrington ordered my client removed for failure to file any relief. I appealed on the grounds that proper pleadings were not taken and my client was not in fact removable. Further I negotiated his release with ICE on a bracelet and was able to have respondent marry his USC Spouse upon release and argued alternatively that respondent would ask for an adjustment with a waiver. The Board sustained the appeal. The case was remanded to North Carolina court to argue the merits of the case.

This is a case where a client was eligible for NACARA. The immigration denied the case on an odd interpretation of the law and we appealed the decision. The judge argued that my client needed to show ... extreme and unusual hardship to warrant a favorable exercise of discretion in his case, however, with NACARA, there is a presumption of hardship. The appeal was sustained by the BIA.

Client was an LPR and was charged with negligent homicide back in 1993. He was sentenced to credit for time served at 2 years for the crime. It was a very tragic circumstance where a family member was ... accidentally shot. My client wanted to renew his Green Card but was always afraid to because he worried that he would be placed in removal proceedings. In fact after reviewing his case, it was determined that I could simply go for a naturalization on him. His crime, while terrible did not prevent him from becoming a USC. He was thrilled once he received his naturalization certificate.
