My client was driving a 2011 BMW 328 southbound on Interstate 5 in the far-right lane in SeaTac, WA. It was dark outside, and the roadway was starting to get slick as the snowstorm was unfolding. A ... t the same time, State Farm’s insured was operating his 2007 GMC K1500, a full-size truck, southbound on Interstate 5 in the far-left lane. Unexpectedly, the defendant lost control of his vehicle and came across two lanes colliding into Plaintiff's BMW, causing it to spin. When the BMW stopped spinning, Plaintiff found himself in the center lane of the highway, looking at oncoming traffic. At that moment, despite being afraid for his life, Plaintiff was able to make the right decision and carefully moved his vehicle off the road, avoiding oncoming traffic. Liability in this matter is undisputed, with State Farm’s insured being the sole party responsible for the subject collision. He admitted as much following the crash when speaking with my client, and the facts of the incident support the same.
