Allenius v. Thomas, 42 Ohio St. 3d 131 (1989)
N/AOUTCOME: Successful appeal to the Ohio Supreme Court
Attorney Sumner received accolades for his oral argument on behalf of plaintiffs before the Ohio Supreme Court in this ground breaking medical malpractice case presenting unique issues regarding when ... the statute of limitations begins to run on a malpractice claim. The Supreme Court adopted, as eloquently argued by Mr. Sumner, the "cognizable event" analysis, which interjected more fairness into the determination as to when the medical malpractice statute of limitations begins to run on a potential negligence claim. The "cognizable event" doctrine still remains good law in Ohio over three decades later.
