Our client was improperly charged with Violating a Domestic Injunction, which as a result deeply and profoundly affected his life. Based on the evidence provided, a dismiss was sought. The dismissal w ... as subsequently granted after a showing that the State failed to meet it's burden of a prima facie case. The State additionally voiced no objection to the motion, further evidencing a lack of a good faith basis when filing the information. Accountability applies to the State Attorney's Office, and sometimes that is overlooked and neglected. This is case and point why having competent legal counsel matters in criminal cases!
