My physician client, who is licensed by the State Medical Board of Ohio ,was investigated for allegedly abusing her patient / romantic partner. Following the investigation, the Board issued the physic ... ian a Notice of Opportunity for Hearing based upon the above refenced allegations. To defend the physician against the allegations and to try to avoid a sanction being issued against the physician's Ohio license, we requested a hearing and fully engaged in preparing for hearing, including making effective use of the Board's subpoena power to collect evidence for hearing. After collecting enough evidence to refute the allegations, we worked with the Assistant Attorney General, assigned to represent the Board, in pushing for dismissal of the charges in the Notice, including sharing key exculpatory evidence that we would have presented at hearing. Fortunately, before a hearing was needed to adjudicate the charges in the Notice, the Board formally dismissed the charges in the Notice.
