We recently handled a case where our client was in line trying to get into a sports bar in Downtown Sacramento. Unfortunately, another patron in line punched our client without any warning. The bouncer ... thought our client was the aggressor. He took our client to the ground, put him in an armbar, and broke his arm. Although some bouncers believe they have a license to behave badly, they do not. Their job is to maintain a reasonably safe environment and conduct themselves in a reasonable manner when dealing with customers and patrons. Bouncers are generally employees of the bar or nightclub and do not have any more rights than its patrons they serve. Bouncers are only allowed to use force if it is first used against them or to protect innocent bystanders from violence. The most important thing to remember here is that if they do use force, it must be justified and reasonable under the circumstances. As for our client, we litigated the case and we were able to settle the case for over a quarter million dollars.
