My client was charged with aggravated sexual battery and sexual battery against his stepdaughter. At trial, we were able to prove that the child's father had asked for custody and the mother had ref ... used to give him custody just a few weeks before the child made allegations against the stepfather. We were also able to show that, physically, things could not have happened the way the stepdaughter testified that they did. There were a number of inconsistencies in all of the different statements made by this alleged victim to the police, to family members, and ultimately to the jury. We pointed out to the jury that the stepdaughter spoke very matter of factly about events when she was interviewed by the police, like she was reading them from a book - but when she had to testify in front of a jury she cried and acted hysterical - this just didn't add up for the the jury. Although this brief summary makes the case sound simple, it was not. The trial lasted more than a week - but the jury deliberated for less than an hour when they came back wtih a verdict of NOT GUILTY on all charges. At the conclusion of the trial, my client went home with his family.
