The mother filed an Application for Determination, hoping ... to resolve the issue. The Iowa Supreme Court held that parties with Joint Legal Custody cannot petition the court to resolve discreet issues; rather, a party must petition for the Court to modify prior decrees or orders, requiring the party to prove a significant or substantial change in circumstances.

OUTCOME: Court of Appeals unanimously agreed with husband.

Wife appealed decree of dissolution of marriage contesting the court's award of joint physical care of the children based on isolated incidents of domestic abuse as well as $63,000 of mortgage debt on ... husband's farm paid down with what she alleged were marital funds. The husband argued the parties had an enforceable premarital agreement. The Court explained that there was not a history of domestic violence for purposes of the statute--that isolated incidents (particularly when the parties mutually engaged in such incidents) were not sufficient to trigger the statutory presumption of primary physical care. On the property, the court agreed that the premarital agreement was enforceable. We represented the husband.

Some of the more nuanced facts of the case were that there was a sizable inheritance at stake which was being held ransom by the opposi ... ng party.
