Ms. McNelis represented Former Wife against Former Husband in a post-divorce Rule to Show Cause, after Former Husband had unilaterally decided to stop paying her court-ordered spousal support. Ms. McNe ... lis successfully argued that Former Husband owed Former Wife two years of overdue spousal support payments. In addition, Ms. McNelis persuaded the court that Former Husband should be responsible for Former Wife’s attorney’s fees. As a result, the court ordered Former Husband to pay Former Wife over $41,000, for overdue spousal support payments and reimbursement for Former Wife’s attorney’s fees spent in pursuit of litigation.

OUTCOME: Husband Ordered to Pay Pendente Lite Child and Spousal Support

Ms. McNelis represented Wife in a hearing for "pendente lite" (pending a final hearing) support. Wife was a mother of two infant children who was forced to leave the marital home when Husband’s abuse b ... ecame dangerous and intolerable. Wife had stayed at home full time with the parties’ infant sons and did not have any family members living in the country. Husband refused to pay spousal and child support to Wife pending the parties’ divorce, so Wife was forced to move into a domestic violence shelter with the children. Ms. McNelis was able to demonstrate Wife's immediate and dire need for spousal and child support to the court. The court ordered Husband to pay Wife approximately $3,000 per month in pendente lite support, as well as over $3,000 in arrearages for the past months in which Husband refused to support Wife and their children. As a result, Wife was able to move out of the domestic violence shelter and into a comfortable and safe apartment with the children.
