During a 10 hour mediation, the crux of the allegations against my client depended upon how the business entities were set up. Following the 10 hour mediation, we settled for $10,000, which was over $5,000,000 less than Plaintiff's counsel initially demanded.

Notwithstanding, there was a mechanism of injury for Plaintiff's alleged injuries that could have resulted in a jury verdict greatly exceeding Plaintiff's demand. Following extensive negotiation, we settled the case for 3/4 less than Plaintiff's initial demand, despite extensive medical bills and treatment.

Due to the flooding, the tenants had to reside in a hotel for nea ... rly 30 days. Despite Santa Monica Municipal Code not being in our favor, we obtained a favorable settlement with the landlord. Particularly, the Santa Monica Municipal Code had a cap on on reimbursement for their expenditures. After it was all said and done, we were able to get around the cap on reimbursements, and the tenants were: (1) reimbursed for all of their expenses at the hotel (nearly $10,000); (2) not charged for rent for the month they were in the hotel, as well as, the following month; and (3) they were not charged for any other bills regarding the premises for that time as well.

Based on the fact that my client never received the keys to the property, the creation of the tenancy was disputed, as he arguably never received possession. Further, there was an issue as to whether any contract defenses of impracticability and/or frustration of purpose discharged my client's obligations under the lease agreement. The dispute was settled with the following terms: (1) landlord kept the first month's advanced payment of rent; (2) my client received a reimbursement of his security deposit; and (3) my client was discharged from all obligations and future obligations under the lease agreement, e.g., rent.
