Trial Court ruled case was automatically dismissed under Uniform Superior Court Rules despite the parties having gone through discovery proceed ... ings and Plaintiff had stipulated case to the Jury Trial Calendar.. Chief Judge Barnes writing for the Ga Court of Appeals reversed the trial court, finding that the "trial court erred in concluding that it lacked subject matter jurisdiction over this case. . ."

OUTCOME: Settlement Affirmed

Baker brought a wrongful death action against his ex-wife Sweat claiming that Sweat caused an auto accident that killed their daughter. The liability insurance carrier settled with ex-wife Sweat, only ... . Baker filed complaint alleging claim was settled improperly with unauthorized parties. The Court of Appeals of GA affirmed the trial court's grant of summary judgment finding that there was clear and convincing evidence that Baker had relinquished his parental rights by failing to support, visit, or establish a relationship with daughter during her lifetime. The court concluded that, as a result, Baker lacked standing to maintain an action for her wrongful death, and dismissed Baker's complaint.
