On March 11, 2020 the Cerro Gordo District Court amended the charge of OWI to Public Intoxication following an independent investigation into the circumstances surrounding reasonable grounds for chemic ... al testing. I was able to demonstrate the time at which my client purchased alcohol, arrived at a party and later submitted to chemical testing. This timeline demonstrated the state would not be entitled to a "two-hour presumption" jury instruction regarding my client's breath alcohol concentration at the time he last drove the vehicle. In doing so, the state would be forced to bring a criminalist to trial to give an opinion of his BrAC at this critical time. There weren't enough facts in the record to even make this determination. As a result, we achieved a rare feat in this county by securing an amended plea to public intoxication. Also, my client served no time in jail.
