The basis for this dismissal was the district court's findings that the government en ... gaged in deceptive conduct and outrageous tactics during these naturalization proceedings. The United States also appeals the suppression of statements made by the defendant on the basis of incompetent translation in the naturalization interview at which the statements were made. For the reasons that follow, we reverse the dismissal of the indictment, reverse the suppression of the statements made at the naturalization interview, and remand the case for further proceedings.

United States after having been deported, in violation of 8 U.S.C. § 1326(a),(b)(2). The district judge dismissed the charge based on her conclusion that the underlying deportation proceedings had been fundamentally unfair. United States v. Aguirre-Tello, 181 F.Supp.2d 1298 (D.N.M.2002). We have jurisdiction under 18 U.S.C. § 3731 and 28 U.S.C. § 1291 to review the district court's dismissal of the indictment.
