The parents of a 10 year old were parenting well, but they couldn't agree on alimony. Conversations about money were tense and became combative. After working with their collaborative attorneys to proj ... ect post-divorce household expenses in both houses, it was clear there wasn't enough income to cover all necessary expenses in both homes for the next five years. The parties had been aggressively saving in retirement accounts and had a sizable marital estate. With the help of their collaborative attorneys, they agreed to take some money from the supporting party's share of the 401(k) and transfer it out (paying income taxes, but no penalty) so that the dependent spouse could draw from that amount monthly over five years to supplement support payments. Both parties were satisfied and they continue to co-parent successfully and cooperatively.
