Upon Requ ... est my Client performed a breatholizer 3 times. Client's readings indicated extreemly high levels of intoxication. Client was the placed under arrest.

Criminal Violation of Conditional Discharge Program

OUTCOME: I was able to have the Court not sentence Client on his multiple violations of probation. The Court then focused on Client's underlining Charge of Possession of CDS. I was able to get Client a sentence of NO JAIL TIME and MINIMAL FINES.

Client was originally charged with a Possession of a CDS (Controlled Dangerous Substance.) A Conditional Discharge Program (CD) is a program where first-time offenders are eligible to enter the 12-mon ... th program and if they abide by the Court Rules and refrain from receiving any added charges or criminal activity, they will complete the CD whereby their original underlying charge will be forfeited, and they will receive no sentence for it. Because Client had no prior Criminal History, he was eligible for the Conditional Discharge Program (CD) were he would need to report to and comply with the Court Imposed Rules for 12 months. However, Client violated his CD by continually failing to appear at his Court Appearances for a serious of months. Violations of Probations by themselves can be offences subject to sentencing.
