This was a civil harassment restraining order case. My client, Ms. Hue, was wrongly accused of harassment and threats against the other party, who had no evidence of such and was only bringing this act ... ion out of spite. Nonetheless, restraining orders cases are serious matters. If her case was not properly handled, Ms. Hue could have wound up with this restraining order on her record having done nothing wrong. I gathered witness testimony and evidence necessary to defend her, and the restraining order was denied after a hearing before a judge in Contra Costa County.

IRMO Elrod v. Elrod

OUTCOME: Modification of Custody in Favor of Client

This was a custody case where Mr. Elrod had dug himself into a bit of a hole prior to retaining me. His case was mismanaged early on in the divorce proceedings and it resulted in his ex wife getting so ... le custody and him getting minimum visitation. I was subsequently retained to undue this poor result. I vigorously fought against attempts to paint Mr. Elrod as a bad father in the eyes of the court. The end result was Mr. Elrod receiving joint custody and a modified visitation schedule with his ex wife. In fact, due to Mr. Elrod's favorable work schedule, I was able to get him 60% visitation with his children. He went from only seeing his kids two weekends per month to having the majority of the week with them - a great result!

IRMO Hemmat v. Moghaddam

OUTCOME: Settlement in Client's Favor

Ms. Moghaddam retained my firm to handle her divorce. However, this was a dissolution case with an interesting wrinkle: whether or not cryptocurrency was to be divided as a community asset. Mr. Hemm ... at was active in Bitcoin and had a portfolio during the marriage valued at over $600,000. In court, opposing counsel argued that the portfolio was separate property because it did not require Mr. Hemmat to actively manage it during the time in which the parties were married. However, the court agreed with my firm's stance that the portfolio was subject to a community presumption and that the nature of volatility of cryptocurrency required liquidation. Following that hearing, I negotiated a settlement agreement with opposing counsel that included a division of the Bitcoin units.
