Rothbury v Double JJ
Jun 01, 2004OUTCOME: My client prevailed in Right to Farm Act Case
The Village of Rothbury sought to enforce a zoning ordinance prohibiting the use of horses and other agricultural activities within the Village limits. I asserted the Right to Farm Act as a defense to ... the Village's suit to enforce the zoning ordinance was partially successful in the circuit court. I appealed the decision of the circuit court to the Court of Appeals and successfully argued that all activities were agricultural and, therefore, protected by the Right to Farm Act.
