Defendant accused of possession of narcotics with intent to deliver, as well as Violations of the Uniform Firearms Act. Defendant was allegedly found sleeping in a bedroom of a house with a gun under ... his mattress and narcotics out in the open in common areas of the home. Cross examination of police officer revealed that an other individual was seen jumping out of that bedroom window as police entered the home with a search warrant. Client found guilty based upon theory that, because there were other individuals who could have had joint access to the narcotics and weapons, his mere presence was legally insufficient.
