Client (J.O.) was a passenger in his uncle’s truck in Hall County when the defendant pulled out in front of them, causing a collision. Moreover, Client’s uncle admitted in his deposition that he had been speeding at the time of the car wreck. Client underwent elbow surgery, chiropractic care, physical therapy, and numerous injections. Client was diagnosed with herniated discs in his lower back and neck at L4-L5, L5-S1, and C6-C7 and incurred $95,000 in medical bills. Surgery was recommended to treat the disc injuries. Attorney Parker McFarland filed a lawsuit in Hall County State Court. Despite the evidence that Client’s uncle was partially at fault in the automobile wreck, a settlement was reached prior to trial for all of the remaining insurance policy limits of $281,198.22.

Desalvo v. State, A09A0935 (8/13/09). Client (L.D.) was charged in Forsyth County Superior Court with aggravated assault by pointing a pistol at the victim as well as criminal damage to property in the ... second degree. However, the State failed to present the case to the grand jury and secure an indictment within the four-year statute of limitations. The State alleged an exception to toll the statute of limitations in the indictment, that the identity of Client was unknown to the State for 18 months. Attorney Parker McFarland filed a Plea in Bar in which he alleged that the identity of Client was in fact known to the State for the entire four years; therefore, the statute of limitations had expired and the case should be dismissed. At the Plea in Bar hearing, the District Attorney told the judge about DNA evidence which resulted in a match of Client 18 months after the incident. However, the District Attorney failed to call any witnesses to prove the exception to the statute of limitations. Attorney Parker McFarland argued that the State failed to carry its burden since the arguments of the District Attorney proved nothing, but the trial judge denied the motion. Attorney Parker McFarland filed an appeal to the Georgia Court of Appeals. The Court of Appeals agreed with Parker McFarland that the State had failed to prove the exception to the statute of limitations, denied the State’s request for a second hearing, and reversed the trial court’s ruling. The result was a dismissal of all charges.

Client (C.L.) was followed by a Forsyth County deputy and observed to abruptly turn into an unoccupied subdivision where there had been recent loitering complaints. The deputy initiated a traffic st ... op. He smelled a strong odor of marijuana and noted physical signs of marijuana use. A drug dog alerted on the Client’s vehicle and a search turned up two ounces of marijuana, a grinder, scales, rolling papers, a pipe, blunt wrappers, and empty baggies. The client was charged with possession of marijuana with intent to distribute. Attorney Parker McFarland filed a Motion to Suppress, asserting that there was no probable cause for the traffic stop and obtained a hearing date. Prior to the hearing in Forsyth County Superior Court, the District Attorney agreed that there was insufficient probable cause for the stop and dismissed all charges.

Client (C.C.) was stopped for driving at a high rate of speed on the wrong side of the road and almost hitting a Forsyth County Sheriff’s deputy head on. The officer said that Client had slurred speech ... , glassy eyes, was unsteady on his feet, swayed while walking, had an open container of liquor, and failed all three field sobriety tests. Client blew .17 on the breath test. Client was charged with DUI Per Se, DUI Less Safe, Wrong Way on Roadway, Speeding in Excess, Reckless Driving, Suspended License, Invalid License, and Open Container. Attorney Parker McFarland filed a Motion to Suppress the breath test result which alleged that the State could not prove that Client consented to taking the test. Client had previously stated “no” to the breath test but the officer kept reading the implied consent warning and repeatedly asked for a test at the jail until Client blew into the machine. The State conceded that the breath test result should be suppressed from evidence. Attorney Parker McFarland proved that Client’s license should not have been suspended and successfully negotiated a Nolo plea (no points) to one count of reckless driving and open container. All remaining charges were dismissed.

State v. R.B. Defendant was charged with DUI in the State Court of Gwinnett County. Client was observed sleeping in his vehicle at a closed gas station with his keys in the ignition and his car lights ... on. Officer observed Client to be generally incoherent and unable to follow simple instructions. Client also displayed mumbled, slurred speech, bloodshot eyes, and a strong odor of alcohol. Officer noted Client was too intoxicated to perform any of the field sobriety tests and refused to allow him to take a breathalyzer test. After the arrest, the Client told the officer he thought he was in Suwanee, but he was actually in Norcross. Attorney Parker McFarland filed a motion to suppress the statements of the client, based on the fact that they were made after his arrest and without the benefit of Miranda warnings. Prior to the motion to suppress hearing, the prosecutor agreed that the statements were inadmissible. The prosecutor agreed that without the statements, there was insufficient evidence to prove driving; therefore, an agreement was reached to reduce the charge to reckless driving.
