Additionally the settlement required defendant to cease any telemarketing efforts that violated the TCPA and not engage in those acts in the future.

After certification, as part of a settlement the ... defendant's insurance carrier agreed to pay the limits of defendant's liability insurance to create a $871,000 cash fund to compensate Missouri consumers who had received the junk faxes touting defendant's services. Additionally the settlement required defendant to cease any telemarketing efforts that violated the TCPA and not engage in those acts in the future.

OUTCOME: $1.5 million recovery for injuries on hotel bus

Our client was a passenger on a shuttle bus operated by a Fortune 500 lodging company. After our 26-year old client and others left an award banquet at the resort’s main building, they boarded a shuttl ... e to return to their cabins. According to police reports the shuttle bus driver lost control of the shuttle bus on a steeply inclined drive causing it leave the roadway and strike a tree. During the crash, our client was thrown about the interior of the shuttle bus and several other passengers came down on our client’s left knee. Due to our client’s recent pre-crash knee surgery, her condition deteriorated after the shuttle bus crash eventually being diagnosed as complex regional pain syndrome Type I, also known as reflex sympathetic dystrophy (RSD). Our investigation revealed the defendant violated their own driver safety, screening and training requirements in both hiring the driver and operating the shuttle bus. We obtained a recovery that included our client’s past medical bills, future medical treatment, past and future lost wages.

We obtained class certification in a lawsuit against a Kansas sales training company for violations of the Telephone Consumer Protection Act (TCPA). While fighting the case we obtained an opinion from ... the Missouri Court of Appeal defining the scope of discovery of the members of the class in a putative TCPA class action in Missouri. Prior to certification as part of a settlement the defendant's insurance carrier agreed to pay the limits of defendant's liability insurance into a cash fund to compensate Missouri consumers who had received the junk faxes touting defendant's services. Additionally the settlement required defendant to cease any telemarketing efforts that violated the TCPA and not engage in those acts in the future.
