I represented a mother who had her child removed from her care by the State. She was rude and difficult to deal with. She would routinely cuss at and berate DCS workers. I argued that her behavior towa ... rds DCS workers had nothing to do with her ability to care for her kid. We lost in the trial Court. The case was taken up on appeal and the Court of appeals agreed with me that the State presented evidence that she was rude to them, but presented no evidence about her ability to care for her child. 130 N.E.3d 1149 Court of Appeals of Indiana.
