OUTCOME: Dismissal of Rape charges

In this case, the State charged Mr. B with Rape and other violent and sexual crimes. The accusation was false. Mr. B's wife made the accusation in order to create leverage in their divorce; she reall ... y wanted the house and she wanted Mr. B deported so that she would have sole custody of their children. Unfortunately, Mr. B spent 10 months in jail as the prosecutor and I litigated multiple motions. Through private investigation and much effort and coordination, I was able to block some of the charges and was able to get pre-trial orders from the Judge which would ensure that Mr. B would get a fair trial. The prosecutor dismissed the case a week before trial admitting that he could not win the case at trial.

OUTCOME: Dismissal of DUI / DMCS case

This was one of the DUI cases which I have won. The charge is actually called "Driving with a Measurable Amount of a Controlled Substance" or DMCS. It is what they charge when they take someone's blo ... od and it turns out that the person was not drunk or high but that they did have metabolite in their system. In other words, they wouldn't pass a drug test even though they were not currently intoxicated. (What a dumb law right?) The Officer had subjected my client to extended and unjustified sobriety testing on a cold January morning. My client was autistic, not high. But the officer didn't know the difference and finally decided to draw his blood. My client had smoked a J in the week prior and was thus charged with a DMCS. I moved the Court to suppress the results of the blood draw because the draw was not supported by a reasonable belief that my client was high on anything. The court agreed. The city was forced to dismiss the case.
