N/AOUTCOME: Idaho Supreme Court reversed and remanded in favor of the State
This case involved an issue of first impression for the Idaho State Supreme Court. I briefed and argued against a motion to dismiss at the magistrate court level when I was an intern during law school. ... It was an issue of statutory interpretation of Idaho Code 37-2732. Although I lost at the magistrate court level, the State appealed to the State Supreme Court and, eventually, the Court sided with my proposed interpretation.
