Brain Injury Case - Missed by TV Lawyer

By way of a referral, a client meet with attorney Roger Krause, MA, JD, complaining his TV lawyer was not doing enough. The client described suffering the classic brain injury after a server rear ... -end collision. The client described having a variable but persistent headache, difficulty paying attention and forgetfulness. Speaking to his family, we learned that since the collision, the client was having mood swings, was irritable, and depressed. We also learned that the TV Lawyer was not working the case, but rather, the case was being handled by a non-attorney 'case manager'. What they missed, attorney Roger Krause immediately recognized. The client needed to be assessed by a neurologist using an EEG (electronic monitoring that shows misfires in the brain) and the client need to be treated medically. The client then selected a neurologist from his healthcare panel, the EEG was conducted, and the client's brain injuries identified and documented. Now, with proper assessment, the neurologist was able to treat the patient and reduce the patient’s discomfort and suffering. Likewise, with the proper medical evidence, coupled with some additional compelling evidence uncovered by attorney Roger Krause in deposition of the defendant, a large settlement was reached. The settlement paid for the client’s past medical care, the patient’s future medical care (which was very important, since the patient found relief by way of an experimental treatment not approved by the HMO), lost earning, and additional compensation for his personal harms.
