Attorney Nye's client was charged with possession of a small amount of marijuana. After the arrest, his client became a registered medical marijuana patient. However, the prosecutor still refused to ... dismiss the case. Attorney Nye's client had the courage to take the case to trial. During trial, through a two hour cross-examination of the Michigan State Trooper, Attorney Nye was able to show the court that the trooper had no lawful basis to search the motor vehicle. Mid-trial, Attorney Nye moved for dismissal of the charges, and the trial judge granted the motion, specifically citing the unconstitutional conduct of the trooper.

Attorney Nye's client was pulled over by a deputy sheriff while on the way to work. Unfortunately, his client had a misc. warrant in another county and was promptly arrested and put in the back of the ... patrol car. The officer then called for a tow truck. While waiting for the tow truck, the young officer decided to conduct an (illegal) search of the vehicle, and found a small amount of expired narcotic medication. The driver was then charged with felony possession of narcotics. Attorney Nye recognized that the officer violated the case of Arizona v Gant which held that the Fourth Amendment requires a warrant for a search of a motor vehicle when the driver no longer has access to the vehicle and there is no other basis to believe the car contained contraband (or if the car is not processed to a written impoundment policy.) Attorney Nye filed a motion to dismiss the charges for the violation of his client's Fourth Amendment rights as held by Arizona v Gant. Upon further review, the prosecutor realized that the officer's conduct was patently illegal, indefensible, and dismissed the charges.

Attorney Nye's client was bogged down in 4 years of negotiations with former business partners after they defaulted on payment for the sale of the client's interest. Frustrated by the tactics of the f ... ormer partner's attorney, who had burned out three of the client's previous attorney's with bad faith negotiations, the client retained Attorney Nye. Nye immediately filed suit, and then immediately filed a motion for a partial victory, which was granted by the court. The matter then was sent to arbitration, and by excellent and clear briefing, Attorney Nye was able to prove to the arbitrator the merits of his client's claim and that the partner's arguments were frivolous and in bad faith. The arbitrator awarded Attorney Nye's client almost every penny of the claims and ordered assets to be seized from the partners and paid to Attorney Nye's client. Attorney Nye was even able to recover most of his client's attorney's fees from the partners.

Attorney Nye's client was charged with leaving the scene of an accident. An elderly man ran into a snow squall, went off from the road, and hit some trees. However, there was a broken utility pole at ... the accident scene. The prosecutor refused to consider the evidence showing that the defendant was innocent of the charge of leaving the scene of an accident causing damage to a public utility pole. At trial, Attorney Nye recreated the accident scene with exhibits, maps, and parts of the vehicle brought into the court room for the jury to examine. The evidence at trial proved that the defendant could not have hit the pole. Although it was a misdemeanor charge and although there was a reasonable plea offer, the defendant had the courage to take the matter to trial and trust Attorney Nye to defeat the government's case.
