In Loco Parentis Standing Custody Dispute
Jan 02, 2020OUTCOME: My client was awarded "in loco parentis" standing.
My client raised a child that was not his biological son for several years. When he separated from his significant other, the mother disputed that he ever stood in the place of the biological father, ... and that he should denied all custody rights. Three separate hearings were held over the course of a year and my client was ultimately found to have parental rights pursuant to the doctrine of "in loco parentis," meaning he had stood in the place of the father, despite having no biological relationship to him.
