Kragen v. Kragen / D-23-663448-D
Feb 01, 2023OUTCOME: Writ of Mandamus GRANTED; matter remanded to District Court and jurisdictional orders vacated.
Child Custody / Divorce matter where parties moved from California; children relocated with one parent short of six (6) months. California courts made a temporary custody order, thereby exercising eme ... rgency jurisdiction; Nevada court subsequently made a temporary order (while the CA emergency orders were in effect) and set a UCCJEA conference to determine the "home state." Nevada Court ruled that Nevada was the home state, although deliberations appeared to indicate that the six-month requirement had not been met. Mother / Client filed a Writ of Mandamus with the Nevada Supreme Court, which was assigned to the Court of Appeals. Mother / Client prevailed and the jurisdictional (Nevada) orders were vacated with instructions.
