OUTCOME: Insurance company capitulated and paid the policy limit.

Plaintiff was in a rear end auto collision while operating a borrowed car. There were three policies of insurance available to compensation plaintiff. The liable driver paid the limit of its policy i ... n the amount of 25,000.00. Plaintiff had an auto and motorcycle policy that provided underinsured motorist coverage. Plaintiff demanded the limits available under the policies, or $125,000. Insurance company claimed the motorcycle policy only provided insurance when the policy holder was injury while on the motorcycle. This was clearly contrary to the Vermont motor vehicle insurance statutes.
