The Plaintiffs owned adjacent parcels of real property. They sold one parcel, retaining easement rights over the same, to the Defendants. The Defendants attempted to improperly restrict the Plaintiff ... s' easement rights, forcing the Plaintiffs to sue to relief in court. The Plaintiffs prevailed on summary judgment in the trial court. The Defendants appealed the trial court's decision to the court of appeals. The court of appeals affirmed the trial court's decision. The Plaintiffs therefore confirmed and retained their easement rights.
OUTCOME: Prevailed and upheld on appeal (Supreme Court denied review) - successfully obtained the dismissal of all claims against my client and obtained a substantial award of costs and fees against the opposing party.
After being designated as the beneficiary of some non-probate assets, my client was wrongfully sued to block him from receiving the funds he inherited. After almost two years of litigation, the suing ... party having failed to produce any evidence sufficient to prevail on her claims, the judge dismissed all claims against my client. The judge also awarded my client a substantial sum in costs and attorneys' fees (a six-figure judgment). The suing party appealed to both the court of appeals and the Supreme Court of Washington. The decision of the trial court was affirmed by the court of appeals and the Supreme Court denied review.
