Division of Child Support Enforcement v. David Bragg
Nov 30, 2016OUTCOME: The court released the garnishment of Mr. Bragg's social security funds.
Mr. Bragg received $900 per month in Social Security Disabilty Insrance. DCSE had 25% of those benefits garnished. As a result, client was homeless and could not support himself. The child support was ... being collected for his son who was 30 years old at he time. The garnished funds were being paid by the mother. The child support order was entered more than 20 years ago and DCSE had not filed to extend the court order. A court order can only be enforced for 20 years unless extended. We argued that the garnishment should be released because the statute of limitations barred enforcement of the child support order.
