Client was charged with double felonies regarding a domestic violence incident. 273.5 is corporal injury to a spouse and 245 an assault likely to cause great bodily harm. Client was facing up to 5 yea ... rs on each count. I ordered medical reports, body-worn camera footage of arrest and scene, and reviewed all police reports with witness statements. The devil is always in the details. I was able to find the inconsistencies which weakened the allegations. I was able to get both felonies dismissed. Client pled to only a P.C. 242 which is a misdemeanor simple battery. No jail or prison time. No domestic violence batterer's classes. Dismissal of the misdemeanor charge in 12 months of clean record. Informal probation with court fees, fines and restitution.

Client was facing LIFE for a double-strike offense (Kidnapping, Robbery, Weapons enhancement, and Conspiracy) and not a very favorable fact pattern. Client was also accused of pc 245 in jail while awai ... ting for the initial case to be adjudicated. A victory would have been 2-3 years in state prison. I was able to have him be released after 7 months in county jail with a 5-year probation by sandwiching all of the charges. Also negotiated that client will be able to withdraw plea on a couple of the counts and have the strikes removed after successful completion of probation. Folks, it doesn't get better than this...

This was excellent because not having a record is better than getting a record and then having a court dismissal. It's always better not to have a case filed, AT ALL!
