An action was brought and the Defendant claimed contributory negligence ... as a defense against Plaintiff. During the defense's motion for summary judgment, the trial judge granted summary judgment in favor of Defendant. Plaintiff appealed, and the NC Court of Appeals reversed the trial court's order stating that the issue of contributory negligence was for a jury to decide whether Plaintiff was contributory negligent or not.
