A client was charged with possession of a controlled dangerous substance and a subsuqeunt violation of probation as a result thereof. My client was also facing Immigration Removal Proceedings, had he o ... pted to enter a plea. I advised my client under Kentucky v. Padilla to seek advice from an Immigration Attorney. I understood advising my client to enter a plea would likely result in deportation, we took the case to trial. At trial my motion to suppress was denied; however, I emphasized to the Judge the lack of evidence put forth by the State, which resulted into a finding of not guilty for my client. By taking a strong advocacy approach on behalf of my client, rather than taking the easy route and entering a plea, my client has the benefit of remaining in America where he has been raised since childhood, and has established strong family and community relations.
