It was discovered by Plianitff's counsel that the employer had set up a separate corporation to own the press and equipment for tax purposes. Plaintiff sued the separate corporation alleging that they were not plaintiff's employer and therefore were liable to the Plaintiff under tort for the defective and unguarded machine. Their insurance company refused to defend the lawsuit, claiming an exclusion in the policy for product liability cases. Plaintiff obtained a $5,000,000.00 judgment against the corporation. Post judgment Plaintiff counsel served defendant insurance company with a writ of garnishment and did post judgment discovery and obtained the insurance policy from the insurance carrier and found that they had misread it and there was actually an exception to the product liability exclusion for defective machinery. The Court agreed with Plaintiff's reading of the policy and the insurance company became liable for the judgment up to their policy limits of one million dollars. The defendant through their carrier thanvbrought a motion to set aside the judgment which was contested by Plaintiff. The matter was resolved prior to hearing for $950,000.00 of the $1,000,000.00 insurance policy.
