Member of the United States Coast Guard held a Merchant Mariner Credential. After the results of a Coast Guard administered drug test came back positive and individual was separated from the Coast Gua ... rd; Coast Guard brought proceedings to revoke his Merchant Mariner Credential. After a two day trial it was apparent that the Coast Guard drug test was not administered in accordance with the Commandant's Instructions which resulted in a mix up of the specimen collection bottles. All claims against the mariner were dismissed with prejudice and the Mariner was subsequently awarded attorneys fees in accordance with the Equal Access to Justice Act.
