Prenuptial Agreements

I met a lovely couple who could not have been more excited about getting married. One party supported his mother and the ever growing concern of her health weighed heavily on him. He expressed interest ... in a prenuptial agreement, however his soon to be spouse felt slighted by the idea. I met with both parties and by the end of the process, both were accepting, in fact eager, regarding the process of a prenuptial agreement. We were able to devise a document that put both parties at ease. I carefully explained the use of a prenuptial agreement and how these are more like insurance, it may never be used however both would breathe a sigh of relief knowing it was there heaven forbid it was ever needed. This document was one of the most difficult I have executed for how differently each felt during the beginning of the process. The key points we address were issues of alimony, the need to continue to provide for the mother, the division of real property and how, and for the spouse how to ensure their protection. By the end of the process I was delighted to hear the spouse, initially resistant, not only felt comfortable, but protected from this document. We choreographed this document not only to benefit one spouse, as most pre-nuptials are read, but to ensure both were protected financially in the future if a divorce ever unfortunately was their reality.
