I was appointed in Hamilton County Criminal Court by Judge Greenholtz to represent one of over 50 alleged members of the Athens Park Bloods gang that had been charged by the Hamilton County District At ... torney General's Office with violation of Tennessee's Racketeer Influenced and Corrupt Organizations (RICO) Act. I was able to obtain a reduced bond for my client that he could afford, but more importantly, the Court ultimately dismissed the Racketeering and Conspiracy to Commit Racketeering charges against my client, noting that the Tennessee RICO statute is narrower than its federal counterpart and that the presentment returned by the grand jury did not comply with the state statute. Since those were the only charges my client had in the presentment, he is eligible for free expungement of the charges.

Home Improvement Fraud Charge Dismissed in Bradley County General Sessions Court

A local entrepreneur was charged with Home Improvement Fraud and arrested after a homeowner falsely accused him of taking payment for remodeling work but not doing any substantial work. At the prelimi ... nary hearing, during cross-examination, attorney Todd W. Gee got the homeowner to admit that the defendant had performed a substantial portion of the contracted work prior to the homeowner's request for a full refund. The judge then declared the matter to be merely a civil dispute and dismissed the case.

Child Abuse Case Dismissed in Bradley County Criminal Court

OUTCOME: Charge Dismissed

A client of mine was charged with Child Abuse Through Neglect because a child was found in filthy conditions. However, the child was neither physically nor mentally harmed. Tennessee law requires that, ... in order to sustain a Child Abuse Through Neglect charge, the state must prove an actual, deleterious effect or harm to the child's health and welfare. State v. Mateyko, 53 S.W.3d 666 (Tenn. 2001). The mere risk of harm is insufficient to support a conviction. I filed a Motion to Dismiss arguing the charge ought to be dismissed because the State could not show that the child had suffered any actual harm. The State then dismissed the charge at our motion hearing date.
