Settlement of a birth injury case arising out of Defendant's negligent performance of a cesarean section resulting in brain damage to the child. The baby was delivered via cesarean-section which was co ... mplicated and involved a prolonged and difficult extraction, necessitating vacuum and forceps assistance. The baby was not delivered for approximately 20 minutes after the uterine incision and 33 minutes after the initial skin incision which was unacceptable and negligent on the part of the doctor. The baby should have been delivered through a vertical incision line prior to the development of a hypoxic-ischemic brain injury. The baby now suffers from quadriplegic cerebral palsy and mental impairments as a result of the delay in delivery. The doctor's insurance policy limits were $200,000. The hospital contributed to the settlement only because the doctor engaged in an educational activity at the time of the delivery in that a first year resident was present and assisting at the delivery.
