$790,000 Settlement Brain Damaged Baby Due to Failure to Properly Perform Cesarean Section

Settlement of a birth injury case arising out of Defendant's negligent performance of a cesarean section resulting in brain damage to the child. The baby was delivered via cesarean-section which was co ... mplicated and involved a prolonged and difficult extraction, necessitating vacuum and forceps assistance. The baby was not delivered for approximately 20 minutes after the uterine incision and 33 minutes after the initial skin incision which was unacceptable and negligent on the part of the doctor. The baby should have been delivered through a vertical incision line prior to the development of a hypoxic-ischemic brain injury. The baby now suffers from quadriplegic cerebral palsy and mental impairments as a result of the delay in delivery. The doctor's insurance policy limits were $200,000. The hospital contributed to the settlement only because the doctor engaged in an educational activity at the time of the delivery in that a first year resident was present and assisting at the delivery.

Patient was immunocompromised, in that she was diagnosed with hereditary spherocytosis and post-splenectomy. She was taken to the hospital with all of the signs and symptoms of a potentially life threa ... tening bacteremia infection. For over 8 hours not one of the treaters diagnosed and/or performed a work-up for infection. The patient's healthcare providers did not diagnose and treat with antibiotics and inexplicably remained in the dark as to her condition despite her continually deteriorating vital signs. The patient's bacteremia infection left untreated for hours , developed into sepsis, septic shock and culminated in death just 24 hours later. Had antibiotics been administered within the first few hours it is likely that the patient would have survived and gone on to live a full and healthy life.

Settlement reached on behalf of a 16 year old boy who developed anaphylactic shock in response to an allergy shot. The allergy shot should never have been administered based on the fact that the boy ha ... d suffered an exacerbation of his asthma the day before the shot and had low pulmonary function as a result. The severe allergic reaction to the shot caused a cardiopulmonary arrest in the doctor's office. Although the boy was resuscitated by emergency medical personnel, he incurred severe, global brain damage. The doctor was only insured for one million dollars.

Plaintiff was admitted to Henry Ford Macomb on October 22, 2007, as she was suffering a heart attack. She was stabilized and then admitted to the ICU. Several days later she fell out of bed and suffe ... red a massive cut over her left eye and forehead. A resident attempted to cauterize the wound in an effort to stop the bleeding, but failed to turn off the pure oxygen flowing into her non-rebreather mask. When the resident applied a thermocauterization device, which reached up to 900 degrees, it caused a flash fire, resulting in signficant burns to her face and a medically induced coma for several weeks. She required around-the-clock care at a nursing home once she was revived. The jury found for the plaintiff and awarded $1.215 million in damages.

Plaintiff was 43 when he presented to Defendant Hospital on May 19, 2005, for an elective posterior thoracic interbody fusion with instrumentation. He was undergoing the procedure for low back pain. Wh ... en he walked into the hospital, he was suffering from no neurological deficits. When he awoke in the PACU after twelve hours of anesthesia and surgery, he was found to be paralyzed from the belly button down. He never regained motor or sensory function and remains a thoracic paraplegic, with neurogenic bladder and bowel. Plaintiff suffered a spinal cord infarction following prolonged hypotension. Other organs showed signs of ischemia including the kidney, gut and liver. In addition to hypotension, hypovolemia, and hypoperfusion, a post-operative hematoma that was compressing on the spinal cord was diagnosed and surgically removed. All of these derangements from normal combined to cause an ischemic infarction (spinal cord stroke) resulting in permanent paralysis.

On May 23, 2007, Plaintiff, a healthy, married 59 year old woman was driving a Dodge Caravan to work when her vehicle was rear-ended at a high rate of speed by a bus. The force of the impact propelled ... Plaintiff’s vehicle several hundred feet forward whereupon it struck a Detroit Edison pole causing the pole to break in half and landing on the roof of her car. The airbags deployed and she was trapped inside the vehicle until she could be removed by first responders. She was taken from the scene to a Trauma Center. On the date of the accident, she was examined and x-rayed by a trauma surgeon. She was admitted secondary to multi-trauma including severe fractures of her left upper extremity, cervical spine, thoracic spine and left ankle. She underwent multiple surgical procedures including open reduction and internal fixation with plate insertion of left humeral fracture, neuroplasty and decompression of the radial nerve, open reduction and internal fixation with plate insertion of radial shaft fracture, open reduction and internal fixation with screws and stabilizing rods for T11 vertebral burst fracture, thoracic spinal fusion and thoracic laminectomy. Closed reduction and immobilization was performed for the left distal ulnar fracture and for the fracture of the left medial fracture of the malleolus. Plaintiff was permanently disabled as a result of the severe left upper extremity injuries, cervical spinal fractures, thoracic spinal fractures and fracture of the medial malleolus. She also continues to suffer from post-traumatic stress and anxiety.
