Sterling Heights Unarmed Robbery -Dismissed

OUTCOME: Dismissed based upon discovery of cell phone data and DNA.

Client was accused of felony unarmed robbery in Sterling Heights. He said he was in New Baltimore on the date and time of the offense at not at the crime scene. However, he was picked out in a lineup a ... nd he was found near the location where a car stolen in the robbery was recovered. The car was tracked based with the assistance of On-Star. We obtained cell phone tower information which showed that our client was in New Baltimore at the time of the offense. Also, a baseball hat was found in the stolen vehicle. The police sent the hat out for DNA testing to the FBI data bank and it came back positive for another party. Cell phone tower data confirmed that the other party was at the scene of the crime on the time and date of the offense.

OUTCOME: 06/21/2017: Macomb Circuit, HYTA retained, no jail and continue probation. 09/13/2017: Grosse Pointe Shores, Reduce to Impaired Driving, Dismiss OUID and Reckless Driving, granted a restricted license, no jail.

Client obtained a new charge for Operating Under the Influence of Drugs and Reckless Driving in Grosse Pointe Shores while he was on felony probation in the Macomb Circuit Court and had HYTA status. Th ... e Macomb County Circuit Court Probation Officer was recommending 180 days in jail. The result was that we were able to KEEP HYTA status and NO JAIL. The matters in Grosse Pointe Shores were reduced to Impaired Driving and NO JAIL was imposed.
