Defeated a child protective order built on decade-old allegations
Sep 16, 2026OUTCOME: Ex parte order vacated after contested hearing
Our client was served with an ex parte child protective order that cut off his contact with his partner's children and took away his right to possess firearms. The petition rested on unproven allegatio ... ns. The children's guardian ad litem could not support the order, and DCFS had declined to open an investigation. We moved to dismiss under the Utah statutes that bar a protective order for a petitioner who is himself subject to protective orders, and we took the petition to a contested evidentiary hearing. The court found the evidence fell short of the required standard of proof and vacated the order. Left in place, it could have lasted for years.
