The client was arrested by the Santa Clara County Sheriff's Office for a number of charges. The client was charged with felony auto theft/"Grand Theft Auto" (CA Vehicle Code Section 10851). The client ... was already on parole for the same type of charge and for evading/fleeing from law enforcement. As such, the client was facing a significant amount of time in prison due to the possibility of a parole violation, if convicted on the current charge. Upon reviewing the case, Attorney Cody Salfen noticed there were serious issues with the prosecution's case. After going through all of the discovery and evidence with a fine-tooth comb and pointing out these flaws and weaknesses to the prosecutor, Cody set the matter for a preliminary hearing on a "time not waived" basis. Just days before the preliminary hearing, the prosecution moved to dismiss the GTA charge due to the insufficiency of the evidence. The client was immediately released from jail and DID NOT get sent back to state prison.
