Exoneration of Wrongfully Convicted Person

OUTCOME: Murder conviction overturned and charges dismissed

In 2006, Client was wrongfully convicted of a 2002. Client engaged Mr. McCann to reinvestigate the murder, and Mr. McCann discovered exculpatory evidence supporting Client's innocence and substantial e ... vidence supporting the guilt of others. Mr. McCann was also able to have the murder weapons tested with with modern DNA testing, which excluded Client as wielding the weapons. Mr. McCann was successful in a post-conviction motion to vacate Client's conviction and sentence. Shortly thereafter, the State dismissed all charges for lack of evidence and Client was fully exonerated.

McCann Law represented a Homeowners Association (HOA) who sued the beneficiaries of the developer of the association for ownership of the common area elements of the association. When the developer pa ... ssed away, the beneficiaries shamelessly attempted to acquire ownership of the HOA’s common area elements through probate since the original deed of the property inadvertently remained in the personal name of the developer and not the HOA. Through creative and complex legal argument, Attorney McCann successfully blocked the probate matter and achieved judgment for title of the common area property in favor of the HOA client.

Reinstating Eligibility of High School Football Player

In July 2018, the Client, a standout high school football player with multiple Division 1 scholarship offers, transferred from a weaker high school football program to a stronger high school football p ... rogram by transferring schools just prior to his senior year. His former school made unfounded and unsubstantiated allegations that the later school must have recruited the player who allegedly also received impermissible benefits by residing with a roommate in the school zone of the new school. The Florida High School Athletic Association (FHSAA) conducted an investigation, resulting with a guilty determination and a one-year ineligibility punishment. Mr. McCann reinvestigated the matter and appealed this determination to the full FHSAA Board of Directors in Gainesville, FL for a formal hearing. Mr. McCann was successful of having The Client’s suspension overturned and immediately reinstating eligibility for his senior year football season. The Client thereafter was able to play NCAA Division 1 football the following year.

Attorney McCann negotiated a settlement with the representatives of the emergency room for all "outstanding" costs to be fully waived.
