Divorcing spouses of some of our 9/11 Firefighter heroes mistakenly believe that they can get half of the hero's disability pension following divorce. I recently handled a case, where the wife thought ... she could do just that. I showed the Court that she was wrong. The formula for calculating the non-disability portion of a public employee's disability pension can be found in Palazzolo v. Palazzolo, 242 A.D. 2d at 689. With this formula, I was able to save that hero a sizeable portion of his retirement benefits.
