I took the position that my client's spouse was unjustly enriched by my client's payoff of the substantial loan debt. Opposing counsel argued that this sum was given to his client during the marriage and that it was a gift and that my client was not entitled to the return of the funds. Case law was not black and white on the parties' issues. The details of the case were very intricate. Our Judge ruled in my client's favor on the issue of repayment and the case settled.
