My Co-Counsel and I obtained a favorable result against BMW NA LLC for breach of express warranty. BMW argued the defects in Plaintiff's vehicle were caused by unauthorized or unreasonable use of the ... vehicle. My co-counsel and I argued there was an electrical defect in the fuel delivery system which caused Plaintiff's vehicle to shut off. After a four (4) day jury trial the Jury returned a verdict in favor of Plaintiff and found BMW was willful in its failure to promptly provide restitution.
